Crown Approves Charges in Dump Truck Fatality

New Westminster – On April 19, 2011, a cement truck collided with a single vehicle resulting in the death of Mark Holmes, a twenty-six year old resident of Coquitlam, British Columbia.

The New Westminster Police Department conducted an extensive investigation which included their Major Crime Unit, Collision Analysis and Reconstruction Team along with independent experts who were able to assist with the investigation.

On June 20, 2012, New Westminster Crown Counsel approved charge of Dangerous Operation of a Motor Vehicle Causing Death s.249(4) of the Criminal Code of Canada against the driver of the cement truck, Mohammad ABDOLMALEKPOOR, a forty three year old resident of Burnaby, British Columbia.

The following Motor Vehicle Act charges have been submitted:

1. Drive a Motor vehicle without Due Care and Attention, s.144(1)(a) Motor Vehicle Act;
2. Driving a Motor Vehicle without Reasonable Consideration, s.144(1)(b) Motor Vehicle Act;
3. Fail to Ensure Vehicle in Safe Operating Condition s.37.22(2) Motor Vehicle Act Regulations; and
4. Operate a Vehicle Without Effective Service Brakes s.6.02(2)(b) Motor Vehicle Act Regulations

The first scheduled court appearance for the Accused ABDOLMALEKPOOR is set for July 9, 2012. He is not currently in police custody.
